These terms constitute a legally binding agreement between you and AB Canada Inc. Please read them carefully before submitting your device for trade-in.
1. Shipping Insurance
All shipments are automatically insured for up to $100 through the selected courier. In the event of loss or damage during transit, we will submit an insurance claim on your behalf. Reimbursement is limited to $100 and is contingent upon approval by the courier. We cannot guarantee claim outcomes or timelines.
Optional Additional Insurance: You may opt for enhanced insurance coverage (up to the full trade-in value). The cost of this additional insurance will be deducted directly from your final trade-in payout. Coverage details and limits are subject to the courier's policy and approval (Canada Post, Purolator, UPS, FedEx, etc.).
All insurance claims are fully governed by the courier's policies and require their explicit approval. AB Canada acts only as a facilitator in submitting claims and makes no guarantees regarding approval, amount, or processing time. You remain fully responsible for properly packaging and shipping your device according to the courier's guidelines.
2. Personal Information and Data Erasure
We strive to erase or reset all personal data and information from devices we receive, in accordance with manufacturer guidelines and applicable privacy laws (such as PIPEDA), before any resale or refurbishment. However, some devices may contain personal information that cannot be fully removed through standard processes, such as physical engravings, laser-etched markings, customizations, or embedded data that is not accessible via software reset.
By submitting your device, you consent to our handling, erasure attempts, and potential resale of the device in its received condition, including any such non-removable personal markings or information. You acknowledge that we are not liable for any residual personal data that cannot be completely erased.
3. Customer Representations and Ownership Transfer
By submitting your device for trade-in, you represent and warrant that: (i) you are the sole and lawful owner of the device, or you have full legal authority to sell or transfer it; (ii) the device is free and clear of any liens, claims, security interests, leases, or financing agreements that could prevent a clean transfer of ownership; (iii) you have full authority to sell the device; and (iv) all information you provided about the device is accurate and complete.
You acknowledge that many devices are subject to financing plans with carriers or third-party lenders. Submitting a financed device is permitted, provided you continue to meet your payment obligations to the lender after the trade-in. You agree that you will not take any action that causes the device to become blacklisted, locked, or otherwise restricted after we have issued payment.
Upon our issuance of payment (or acceptance of a revised offer), ownership of the device transfers fully and irrevocably to AB Canada. The transaction is considered a final sale. We reserve the right to reject any submission, demand repayment of the trade-in amount, or pursue other remedies if we discover that these representations were untrue or if the device becomes blacklisted due to your actions or omissions after payout.
4. Payment Processing Time
Payment is processed within 24 hours of final offer acceptance via Interac e-Transfer. AB Canada reserves the right to modify available payment methods with reasonable notice. AB Canada is not responsible for delays caused by factors outside our control, such as banking delays or service interruptions.
5. Limitation of Liability
AB Canada is not liable for any loss, damage, theft, or delay occurring during transit, regardless of cause. By agreeing to this policy, you acknowledge that shipping risks are borne by you, and our role is limited to processing received devices and facilitating claims where applicable. In no event shall AB Canada be responsible for consequential damages, lost data, or any indirect losses related to your device.
6. Shipping and Packaging
AB Canada provides a prepaid shipping label. You are responsible for adequately packaging the device according to the courier's guidelines using the provided shipping label and secure packaging materials. Once received, the device becomes AB Canada's property only upon acceptance of the final offer.
7. Governing Law
These terms are governed by the laws of the Province of Ontario and applicable Canadian federal laws. Any disputes shall be submitted to the exclusive jurisdiction of Ontario courts.
8. Changes to This Policy
